WELCOME TO THE TERMS OF USE FOR THE ELAMIR WELLNESS WEBSITES AND PLATFORMS, INCLUDING https://elamirwellness.com/, https://diabesityreversalmethod.com/, https://metabolicweightlossmethod.com/, AND ANY ASSOCIATED SOFTWARE, MOBILE APPLICATIONS, PROGRAM PORTALS, MEMBERSHIP AREAS, CONTENT LIBRARIES, EMAIL COMMUNICATIONS, AND SERVICES (COLLECTIVELY, THE “PLATFORM”).

THIS IS A LEGALLY BINDING AGREEMENT (“AGREEMENT”) BETWEEN ELAMIR WELLNESS, LLC (“ELAMIR WELLNESS,” “WE,” “US,” OR “OUR”) AND YOU (“YOU,” “YOUR,” OR “USER”). BY ACCESSING, USING, PURCHASING FROM, OR INTERACTING WITH THE PLATFORM, YOU AGREE TO BE BOUND BY THIS AGREEMENT AND OUR PRIVACY POLICY, WHICH IS INCORPORATED HEREIN BY REFERENCE. IF YOU DO NOT AGREE, DO NOT USE THE PLATFORM.

IMPORTANT: THIS AGREEMENT CONTAINS A MANDATORY ARBITRATION CLAUSE AND A CLASS ACTION WAIVER THAT AFFECT YOUR LEGAL RIGHTS.

1. ELIGIBILITY

The Platform is intended for individuals who are 18 years of age or older. By using the Platform, you represent and warrant that you meet this requirement.

2. MODIFICATIONS TO TERMS

We reserve the right to amend this Agreement at any time. Updates will be reflected by revising the “Last Updated” date above. Continued use of the Platform after changes constitutes acceptance of the revised terms.

3. PRIVACY

Your use of the Platform is governed by our Privacy Policy, which explains how we collect, use, and protect your information. The Privacy Policy is incorporated into this Agreement and forms part of it.

4. ACCOUNT REGISTRATION & SECURITY

Certain portions of the Platform may require account registration. You agree to provide accurate, current, and complete information and to maintain the confidentiality of your login credentials. You are responsible for all activity that occurs under your account. Notify us immediately of any unauthorized use or security breach.

7. PLATFORM PROVIDED “AS IS”

THE PLATFORM AND ALL CONTENT ARE PROVIDED ON AN “AS IS,” “AS AVAILABLE,” AND “WITH ALL FAULTS” BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not guarantee uninterrupted access, error-free operation, or accuracy of information.

8. USER CONTENT

“User Content” includes any content you submit, post, upload, or transmit through the Platform.

You retain ownership of your User Content, but by submitting it you grant Elamir Wellness a non-exclusive, royalty-free, worldwide, irrevocable, transferable license to use, reproduce, modify, distribute, display, and create derivative works for Platform operation, education, or marketing purposes.

We reserve the right to remove or restrict User Content that violates these Terms or community standards.

9. USER CONDUCT

You agree not to:

Violate any laws or regulations

Infringe intellectual property rights

Post misleading, abusive, obscene, or harmful content

Attempt to interfere with Platform security or functionality

Use automated systems (bots, scrapers) without permission

Violation may result in suspension or termination without notice.

10. INTELLECTUAL PROPERTY

All content, trademarks, logos, text, graphics, videos, and materials on the Platform are owned by or licensed to Elamir Wellness and protected by copyright and intellectual property laws. Unauthorized use is prohibited.

11. LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY LAW, ELAMIR WELLNESS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE PLATFORM.

OUR TOTAL LIABILITY SHALL NOT EXCEED $100 USD, EXCEPT WHERE PROHIBITED BY LAW.

12. INDEMNIFICATION

You agree to indemnify and hold harmless Elamir Wellness and its officers, employees, and agents from any claims, damages, or expenses arising from your use of the Platform or violation of this Agreement.

13. TERMINATION

You may stop using the Platform at any time. We reserve the right to suspend or terminate access for violations of these Terms or applicable law. No refunds are provided upon termination unless required by law.

14. GOVERNING LAW

This Agreement shall be governed by the laws of the State of Arizona, without regard to conflict-of-law principles.

15. ARBITRATION & CLASS ACTION WAIVER

Any dispute arising from this Agreement shall be resolved by binding arbitration administered by the American Arbitration Association in Arizona. Disputes must be brought on an individual basis only. You waive the right to participate in class or representative actions.

16. FORCE MAJEURE

We are not liable for delays or failures caused by events beyond our reasonable control, including acts of God, natural disasters, pandemics, labor disputes, or technology failures.

17. SEVERABILITY

If any provision is found unenforceable, the remaining provisions shall remain in effect.

18. ENTIRE AGREEMENT

This Agreement and the Privacy Policy constitute the entire agreement between you and Elamir Wellness regarding use of the Platform and supersede all prior agreements.

Your privacy is important to Elamir Wellness. This section summarizes how we collect, use, and protect your information. A full standalone Privacy Policy may also be provided and is incorporated by reference.
